繼隆基綠能與晶科能源之后，又有兩大光伏龍頭在專利糾紛上達成和解。

11月29日00:00左右，正泰新能和晶澳科技同時發布《關于達成專利糾紛全球和解的聯合聲明》。

根據和解協議，雙方同意：終止在全球范圍內正在進行的全部專利糾紛法律程序，并就雙方各自持有的TOPCon專利達成交叉許可；而且雙方承諾，在全球范圍內不再就TOPCon專利向對方提起任何專利相關的訴訟或其他程序。

今年9月19日，隆基綠能與晶科能源共同發布《關于達成專利訴訟和解的聯合聲明》，宣布就雙方及雙方關聯公司在全球范圍內正在進行的相關專利主張和法律事項達成和解協議。

正泰新能與晶澳科技在和解協議中稱，此次和解的達成，是雙方守正創新、互利共贏的務實體現，也為行業構建健康、可持續的知識產權合作模式樹立典范；雙方將立足新起點，凝心聚力，持續強化前沿技術研發，推動高效光伏技術商業化落地與場景創新，并攜手開拓更深層次、更寬維度的戰略協同。

過去一年多，光伏陷入內卷式競爭，其中一個重要體現是專利侵權糾紛案不斷涌現。此后，反內卷成為了行業主旋律。

兩個多月來，四大光伏龍頭在專利糾紛上達成全球和解，這對光伏行業來說是轉向利好的信號，也意味著光伏反內卷取得了重要進步。

隨著全球能源轉型加速，中國光伏產業正在邁入以技術創新引領的“質量躍升”新階段。正泰新能科技股份有限公司（以下簡稱“正泰新能”）與晶澳太陽能科技股份有限公司（以下簡稱“晶澳科技”）作為行業的重要推動者，始終秉持創新驅動的發展理念，持續加大研發投入，完善全球知識產權布局，打造維護尊重和保護知識產權的市場環境，共同致力于推動產業技術進步與可持續發展。

As the global energy transition accelerates, China’s photovoltaic industry is entering a new phase marked by higher quality and innovation-driven growth. Chint New Energy Technology Co., Ltd. (hereinafter referred to as “Astronergy”) and JA Solar Technology Co., Ltd. (hereinafter referred to as “JA Solar”), as key industry promoters, have consistently prioritized technological innovation, increased investment in R&D, and strengthened their global intellectual property portfolios. Both parties are committed to fostering a market environment that upholds and safeguards intellectual property rights. Both companies remain committed to advancing PV technologies and supporting the sector’s long-term sustainable development.

2025年11月29日，正泰新能與晶澳科技聯合宣布：雙方及雙方關聯公司（以下簡稱“雙方”）針對在全球范圍內正在進行的專利糾紛已達成和解。

Building on mutual agreement, on November 29, 2025, Astronergy and JA Solar jointly announced that the two companies and their affiliates (hereinafter referred to as “Two Sides”) have reached a settlement regarding the patent disputes currently ongoing worldwide.

根據和解協議，雙方同意：終止在全球范圍內正在進行的全部專利糾紛法律程序，并就雙方各自持有的TOPCon專利達成交叉許可；而且雙方承諾，在全球范圍內不再就TOPCon專利向對方提起任何專利相關的訴訟或其他程序。

Under the terms of the agreement, the Two Sides agree as follows:

? All ongoing legal proceedings relating to patent disputes worldwide shall be terminated;

? The Two Sides have reached an agreement on cross-licensing of TOPCon-related patents owned by each side;

? For the term of the agreement, the Two Sides undertake that, in the future, neither shall initiate any litigation or other proceedings against the other in any jurisdiction worldwide in relation to TOPCon-related patents.

此次和解的達成，是雙方守正創新、互利共贏的務實體現，也為行業構建健康、可持續的知識產權合作模式樹立典范；雙方將立足新起點，凝心聚力，持續強化前沿技術研發，推動高效光伏技術商業化落地與場景創新，并攜手開拓更深層次、更寬維度的戰略協同。
