近日，一則“AI演員簽約出道”的消息引發網友熱議，相關話題登上熱搜。

A Chinese production company's announcement that it has signed two AI-generated actors has sparked a heated debate online, with many viewers expressing discomfort over the digital performers' striking resemblance to real-life stars.

3月18日，耀客傳媒官宣簽約兩位AI數字藝人秦凌岳（男）和林汐顏（女），同時推出首部AI劇集。

據了解，目前，兩位AI演員已在社交媒體抖音、小紅書開通賬號，宣稱將分享“日常”并與網友互動。

On Wednesday, Yaoke Media unveiled Qin Lingyue and Lin Xiyan, two AI-powered virtual actors, and announced plans to release its first drama series featuring the digital talent. Accounts on social media platforms Douyin and Xiaohongshu have also been registered for the pair, where they will share "daily life" content and interact with followers.

然而，消息一出，不少網友直言，根本不想看AI演電視劇，覺得 “假人感太重、沒有靈氣”。

還有網友指出，這兩位AI演員的長相撞臉多位明星，五官、神態甚至聲音都與幾位藝人高度相似，瞬間引發不少網友抵制：

The announcement was met with widespread skepticism. Many users balked at the idea of watching AI perform in scripted series, arguing that the digital figures lack the emotional depth and authenticity of human actors. One user wrote that they felt "too artificial, with no soul and no spark".

Others noted that the AI actors bear an uncanny resemblance to several established celebrities, in both facial features and vocal tone. The similarity has prompted calls for a boycott, with critics accusing the company of creating unauthorized digital replicas of real performers.

據中青報·中青網消息，北京德和衡律師事務所副總裁、高級權益合伙人陳燕紅對記者表示，AI演員“撞臉”明星，即未經許可使用AI生成的與明顯高度相似的面孔進行商業活動，存在的法律風險，可能涉及侵犯肖像權，在特定情況下還可能構成不正當競爭。

Legal experts have also weighed in on the controversy. Chen Yanhong, a partner at Beijing DHH Law Firm, told China Youth Daily that using AI-generated faces that closely resemble recognizable celebrities for commercial purposes could constitute a violation of portrait rights. In some cases, she added, it may also amount to unfair competition under Chinese law.

若AI生成的虛擬面孔足以使一般公眾能夠明確、無誤地識別出其所對應的特定明星時，該虛擬形象就可能落入了該明星肖像權的保護范圍。即使AI聲稱是“合成”或“虛構”，但只要其與某明星的面部特征、神韻具有高度、穩定的指向性，可能導致公眾誤認為明星，使用該AI形象就可能構成“利用信息技術手段”制作并使用了他人的肖像。在這種情況下，使用AI演員“撞臉”明星，就存在侵犯肖像權的法律風險。

陳燕紅強調，使用AI演員“撞臉”明星，還可能構成不正當競爭行為。《反不正當競爭法》第七條規定，經營者禁止擅自使用他人有一定影響標識的混淆行為。如使用該AI明星形象的知名度，在相同或類似領域進行商業宣傳、直播帶貨等，誤導消費者認為其與明星存在代言、合作等特定聯系，從而獲取不正當的交易機會，還可能構成不正當競爭。

AI生成短劇盜用模特攝影作品被下架

隨著AI技術廣泛應用，此類侵權行為愈發普遍。

近日，有網友反映，一部播放量超2300萬的AI生成短劇《鮫珠引》，疑似盜用攝影師原創作品的模特形象與妝造，引發侵權爭議。該作品模特馬女士表示，劇中使用的造型為自己與攝影師的原創。經馬女士維權投訴，目前該AI短劇已被平臺下架。

針對此事，上海申浩律師事務所顧璽曦律師稱，短劇制作方可能涉及肖像權侵權與著作權侵權行為。

律師提醒，若發現AI侵權行為，應第一時間通過網頁截圖、錄屏等方式固定證據，然后盡快去尋找律師，尋求法律幫助。

Experts advised that anyone who suspects their likeness has been used without permission should preserve evidence, such as screenshots or screen recordings, and seek legal counsel.
