1.優秀創新人才一般應在海外高校、科研機構、企業研發機構獲得正式教學或者科研職位，且具有連續36個月以上工作經歷（境外取得博士學位可放寬至24個月）；未全職回國（境）（來華）或2025年1月1日后全職回國（境）（來華）。
2.優秀創業人才全職回國不超過6年，創辦企業2年以上5年以下，本人是企業主要創辦人且第一大股東或者最大自然人股東，一般應在海外取得學位。
